Women Met In Washington DC With Representative in Congress To Lobby For The Medical Devices Safety Act

Tuesday, May 21, 2019 - For the second week in a row, The Medical Devices Safety Act (MDSA) is important news that will affect the future of women suffering from the faulty and dangerous Essure birth control device. Women who have been harmed by Essure met together in Washington D.C. with representatives from Congress to lobby for the enactment of the legislation that will permit patients damaged by faulty medical devices to sue manufacturers of the devices for punitive damages which could be in the hundreds of millions of dollars. As it now stands, the patient can sue medical devices makers for reimbursement of actual expenses related to the medical device in question.

The science division of National Public Radio picked up on the basic tenant of the MDSA, that in 2008 the Supreme Court ruled that a medical device manufacturer was immune from litigation if the device in question was approved by the US Food and Drug Administration (FDA). The problem today, over 10 years later is that the FDA's once strict the thorough medical device approval process has been streamlined, to put it politely, and more and more medical devices are being recalled or are proving to injure patients. Most medical devices that seek FDA approval today do so using the FDA's 510 (k) fast-track approval process that bypasses the scrutiny and delays of pre-market human testing and allows a medical device to go immediately to market as long as the device can be proven to be similar to another one that is already on the market, whether or not the device has subsequently been found to be defective. In essence, the FDA has abdicated its responsibility for overseeing the medical devices industry and manufacturers now must be held accountable. This week, The Essure Problems Weekly newsletter reports that "Women across the US continue to report findings out of date materials and advertising in doctors offices. Over 1000 women have reported becoming pregnant in spite of being implanted with Essure. 75 new members joined the Essure Problems Facebook group this week reporting an issue or related pain and complications. Three women reported having lost body parts including the uterus fallopian tube's cervix and ovaries during surgeries designed to remove Essure. Thousands of women continue to report autoimmune system problems. Lastly, the FDA continues to refuse to revoke is yours p.m. a post to market in spite of proof of violations."
